This Privacy Policy describes how Mixus Inc. (“Mixus,” “we,” or “us”) processes information we collect when you access or use our websites and other online products and services that link to this Privacy Policy (the “Services”), or when you otherwise interact with us, such as through our customer support channels.

If you use the Services on behalf of an entity (such as your employer), we may process information you provide to the Services pursuant to our agreements with that entity rather than this Privacy Policy.

This Privacy Policy is effective as of the “Last Updated” date above. We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the “Last Updated” date. Where required by law, we will provide you with additional notice (such as by adding a statement to the Services or sending you a notification).

Information You Provide to Us

We collect information directly from you when you create an account, use our AI services, request customer support, or otherwise communicate with us. The categories of information we collect include:

Identification Information: We collect your name, email address, phone number (only if you opt-in to SMS/WhatsApp features), and username.

Communication Information: We collect information included in your communications with us, including customer support interactions.

We may also collect any other information you choose to provide.

Information We Collect Automatically

We automatically collect the following categories of information:

Device and Technical Information: We collect information about how you access our Services, including:

  • IP address
  • Browser type and version
  • Operating system version
  • Device type (mobile/desktop)

  • AI conversation context and memory to improve AI responses
  • Usage patterns for service improvement (aggregated and anonymized)

Use of Information

Service Delivery: We use information to provide and maintain our Services, including AI processing, automation workflows, and integration functionality.

Communication: We use information to communicate with you about Mixus and our Services, including to send you system notifications, respond to your questions, inform you of service changes, and send you other transactional or relationship messages.

Authentication and Security: We use information to authenticate accounts, manage user sessions, detect and prevent security incidents, fraud, and other malicious or illegal activity.

Payment Processing: We use transactional information to process payments, manage subscriptions, and generate billing invoices.

Research and Development: We use information to monitor and analyze Services trends, usage, and activities, improve our products and services, develop new features, and generate aggregated and anonymized analytics data.

Legal Compliance: We use information to comply with our legal and financial obligations.

Other Uses with Notice/Consent: We may also use information in other circumstances after giving you notice and/or getting your consent.

Analytics

We use analytics services to understand how users interact with our Services, improve performance, and develop new features. These providers may collect information such as pages visited, session duration, feature usage, and technical performance data.

We do not engage in behavioral advertising or share your data with advertising partners. We do not sell your personal information to any third parties. All analytics data is used solely to improve our Services.

AI Data Processing

When you use AI-powered features of the Services, the content of your prompts, chat messages, and uploaded documents may be transmitted to third-party AI providers including Anthropic, OpenAI, and Google AI for processing. These providers process your data under their respective privacy policies.

We do not use your content to train AI models. AI-generated responses, conversation context, and memory data may be stored in vector databases (such as Pinecone) to enable personalized AI experiences. You can manage or delete your AI memory data through your account settings.

Disclosure of Information

We disclose information as follows:

Service Providers: We disclose information to vendors, service providers, contractors and consultants that need this information to provide services to us, including:

  • Authentication service providers (Clerk)
  • Cloud infrastructure providers (MongoDB Atlas, AWS S3 for secure storage)
  • AI service providers (Anthropic, OpenAI, and Google AI for processing prompts and generating responses)
  • Payment processors (Stripe for subscription and billing management)
  • Email service providers (Postmark)
  • SMS service providers (Twilio)
  • Analytics providers (PostHog)
  • Error monitoring services (Sentry)
  • Vector database providers (Pinecone for AI memory and conversation context)

Professional Advisors: We disclose information to our lawyers and other professional advisors where necessary to obtain advice or otherwise protect and manage our business interests.

Legal Authorities and Others Involved in Legal Proceedings: We may disclose information to legal authorities and others for compliance and protection purposes, including if we believe that disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements and if we believe that your actions are inconsistent with our user agreements or policies, if we believe that you have violated the law, or if we believe it is necessary to protect the rights, property, and safety of Mixus, our users, the public, or others.

Corporate Transactions: We reserve the right to disclose information in connection with, or during negotiations of certain corporate transactions, including the merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.

Affiliates: We reserve the right to disclose information between and among Mixus and any current or future parents, affiliates, subsidiaries, and other companies under common control and ownership.

Consent: We may disclose information when we have your consent or you direct us to do so.

We also disclose de-identified information that cannot reasonably be used to identify you.

Transfer of Information

Mixus Inc. is headquartered in the United States and we have operations and vendors in the United States and other countries. Therefore, we and those who perform work for us may transfer your information to, or store or access it in, jurisdictions that may not provide levels of data protection that are equivalent to those of your home jurisdiction.

Applicant Information

When you apply for a position with Mixus, we collect the information that you provide in connection with your application. This includes name, contact information, professional credentials and skills, educational and work history, and other information that may be included in a resume or provided during interviews (which may be recorded). This may also include demographic information. We may also conduct background checks and receive related information.

We use applicants' information to facilitate our recruitment activities and process applications, including evaluating candidates and monitoring recruitment and hiring statistics. We use successful candidates' information to administer the employment or independent contractor relationship.

We may also use and disclose applicants' information (a) to improve our Services, (b) as otherwise necessary to comply with applicable laws, (c) to respond to subpoenas or warrants served on Mixus, and (d) to protect and defend the rights or property of Mixus or others.

Data Retention

We retain your personal information for as long as your account is active or as needed to provide the Services. When you close your account, we will delete or anonymize your personal information within 30 days, except where we are required to retain certain information for legal, tax, or business purposes (such as billing records, which may be retained for up to 7 years for tax compliance).

Your Privacy Rights

Depending on your location, you may have the following rights regarding your personal information:

  • Access: Request a copy of the personal information we hold about you
  • Correction: Request that we correct inaccurate or incomplete information
  • Deletion: Request that we delete your personal information
  • Portability: Request your data in a portable, machine-readable format
  • Objection: Object to certain processing of your information

California Residents (CCPA): You have the right to know what personal information we collect, use, and disclose; the right to delete your personal information; and the right to opt out of the sale of personal information. We do not sell personal information.

EU/UK/EEA Residents (GDPR): You have additional rights including the right to restriction of processing and the right to lodge a complaint with your local data protection supervisory authority.

Children's Privacy

Our Services are not directed to individuals under the age of 13. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe we have inadvertently collected information from your child under 13, please contact us at support@mixus.ai and we will promptly delete such information.
